Bu konutlardan 2000 y\u0131l\u0131ndan sonra yap\u0131lan 5 milyon konut haricindeki 14 milyon konutun deprem riski bulunmaktad\u0131r. Rapor sonucu binan\u0131z riskli ise Bakanl\u0131k Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fc bir yaz\u0131 ile bina tapu k\u00fct\u00fc\u011f\u00fcne Riskli Yap\u0131 \u015ferhini koyar.<br \/>\n* T\u00fcm kat maliklerine \u0130lgili Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019nden Bakanl\u0131k Resmi Yaz\u0131s\u0131 g\u00f6nderilir. Resmi yaz\u0131n\u0131n tebli\u011finden sonra bina riskli ise 60 g\u00fcn i\u00e7inde bina maliklerinin en az 2\/3 (tapu hisse) \u00e7o\u011funlu\u011fu ile Bina Ortak Karar Protokol\u00fc haz\u0131rlan\u0131p imza alt\u0131na al\u0131n\u0131r.<br \/>\n* Ba\u011fl\u0131 bulunulan \u0130l \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 Kentsel D\u00f6n\u00fc\u015f\u00fcm M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019ne bilgi ama\u00e7l\u0131 bir dilek\u00e7e ile Bina Ortak Karar Protokol\u00fc sunulur. A s\u0131n\u0131f\u0131 enerji performans\u0131na sahip bir bina en tasarruflu bina olurken G s\u0131n\u0131f\u0131 enerji performans\u0131na sahip bir bina ise bu s\u0131n\u0131fland\u0131rman\u0131n en d\u00fc\u015f\u00fck seviyesindedir.<br \/>\nYeni yap\u0131lacak olan binalarda en d\u00fc\u015f\u00fck enerji seviyesi C olabilir. Bu binalarda enerji s\u0131n\u0131f\u0131 C&#8217;nin alt\u0131nda ise mimari, mekanik, elektrik vs. projelerinde enerji tasarrufunu artt\u0131r\u0131c\u0131 d\u00fczenlemeler yap\u0131p proje yeniden yap\u0131land\u0131r\u0131lmal\u0131d\u0131r. Mevcut binalarda ise b\u00f6yle bir durum s\u00f6z konusu de\u011fildir.<\/p>\n<p><b>Mevcut binalar 2 May\u0131s 2017 tarihine kadar Enerji Kimlik Belgesi almak zorundad\u0131r.<\/b><\/p>\n<p>T\u00fcrkiye&#8217;de yeni yap\u0131lan binalarda Enerji Kimlik Belgesi \u00e7\u0131kartmak 1 Ocak 2011 tarihi itibari ile zorunlu hale getirilmesine kar\u015f\u0131n mevcut binalara Enerji Kimlik Belgelerini tamamlamalar\u0131 i\u00e7in 2017 y\u0131l\u0131na kadar s\u00fcre tan\u0131nm\u0131\u015ft\u0131r. Mevcut binalar i\u00e7in enerji s\u0131n\u0131f\u0131 s\u0131n\u0131rlamas\u0131 bulunmamaktad\u0131r. Yani mevcut binan\u0131z\u0131n enerji s\u0131n\u0131f\u0131 C s\u0131n\u0131f\u0131n\u0131n alt\u0131nda \u00e7\u0131kabilir. Binalarda Enerji Performans\u0131 Y\u00f6netmeli\u011fine g\u00f6re 2017 y\u0131l\u0131ndan sonra binan\u0131z\u0131n enerji s\u0131n\u0131f\u0131n\u0131n C s\u0131n\u0131f\u0131n\u0131n alt\u0131nda olmas\u0131 halinde ise bina sahiplerini pek \u00e7ok yapt\u0131r\u0131m beklemektedir. 2017 y\u0131l\u0131ndan sonra t\u00fcm bina al\u0131m- sat\u0131m ve kiralamalar\u0131nda Enerji Kimlik Belgesinin ibraz edilmesi zorunlu olacakt\u0131r.<br \/>\nSanayi alanlar\u0131nda i\u015fletme ve \u00fcretim faaliyetleri y\u00fcr\u00fct\u00fclen binalar, planlanan kullan\u0131m s\u00fcresi iki y\u0131ldan az olan binalar, toplam kullan\u0131m alan\u0131 50 m\u00b2\u2019nin alt\u0131nda olan binalar, seralar, at\u00f6lyeler ve m\u00fcnferit olarak in\u015fa edilen ve \u0131s\u0131t\u0131lmas\u0131na ve so\u011futulmas\u0131na gerek duyulmayan depo, cephanelik, ardiye, ah\u0131r, a\u011f\u0131l ve benzeri binalar bu y\u00f6netmeli\u011fin kapsam\u0131 d\u0131\u015f\u0131ndad\u0131r.<br \/>\nYine, yap\u0131lacak d\u00fczenlemeler sayesinde binalar enerji s\u0131n\u0131flar\u0131na g\u00f6re bir vergilendirmeye tabi tutulacakt\u0131r. Enerji s\u0131n\u0131flar\u0131 bak\u0131m\u0131ndan s\u0131n\u0131fland\u0131rmaya tabi tutulan binalar at\u0131k enerji verimliliklerine g\u00f6re vergilendirilebilecek, en \u00e7ok vergiyi G s\u0131n\u0131f\u0131 en az vergiyi A s\u0131n\u0131f\u0131 olmak \u00fczere verimliliklerine g\u00f6re \u00f6deyeceklerdir.<br \/>\n2017 y\u0131l\u0131ndan sonra t\u00fcm bina al\u0131m &#8211; sat\u0131m ve kiralamalar\u0131nda Enerji Kimlik Belgesinin ibraz edilmesi zorunlu olacakt\u0131r. B\u00f6ylece sat\u0131n alan veya kiralayan ald\u0131\u011f\u0131 yap\u0131n\u0131n Enerji S\u0131n\u0131f\u0131n\u0131n ne oldu\u011funu bilecek ve tercihini buna g\u00f6re yapabilecektir. Bu da binalara olan talebi ve yap\u0131 fiyatlar\u0131na yans\u0131yacakt\u0131r.<\/p>\n<p>MADDE 25 &#8211; (15) (Ek:RG-1\/4\/2010-27539) Binalar veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlere ili\u015fkin al\u0131m, sat\u0131m ve kiraya verme ile ilgili i\u015f ve i\u015flemlerde enerji kimlik belgesi d\u00fczenlenmi\u015f olmas\u0131 \u015fart\u0131 aran\u0131r. Binan\u0131n veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn sat\u0131lmas\u0131 veya kiraya verilmesi safhas\u0131nda, mal sahibi enerji kimlik belgesinin bir suretini al\u0131c\u0131ya veya kirac\u0131ya verir.<br \/>\nGE\u00c7\u0130C\u0130 MADDE 3 \u2013 (1) Mevcut binalar ve in\u015faat\u0131 devam edip hen\u00fcz yap\u0131 kullan\u0131m izni almam\u0131\u015f binalar i\u00e7in Enerji Verimlili\u011fi Kanununun yay\u0131m\u0131 tarihinden itibaren on y\u0131l i\u00e7inde Enerji Kimlik Belgesi d\u00fczenlenir. (Enerji Verimlili\u011fi Kanununun yay\u0131m tarihi 02.05.2007\u2019dir. )<\/p>\n<p><b>Is\u0131 yal\u0131t\u0131m projesi zorunlulu\u011fu<\/b><br \/>\nBinalarda Enerji Performans\u0131 y\u00f6netmeli\u011fi ile yeni getirilen bir di\u011fer \u00f6nemli husus da \u0131s\u0131 yal\u0131t\u0131m projesi zorunlulu\u011fudur. Yeni yap\u0131lan binalarda yap\u0131 kullan\u0131m izni alabilmek i\u00e7in i\u00e7eri\u011fi mevzuata uygun olarak haz\u0131rlanm\u0131\u015f bir \u0131s\u0131 yal\u0131t\u0131m projesi haz\u0131rlanmas\u0131 zorunludur. Aksi halde yeni yap\u0131lan binan\u0131n yap\u0131 ruhsat\u0131 al\u0131namayacakt\u0131r.<br \/>\nSonu\u00e7 olarak 2017 y\u0131l\u0131 itibari ile enerji kimlik belgesi olmayan binalar\u0131n al\u0131m &#8211; sat\u0131m ve kiralamalar\u0131 yap\u0131lamayacak \u00fcstelik daha y\u00fcksek vergiler \u00f6demek zorunda kalacaklard\u0131r. B\u00f6yle bir durumla kar\u015f\u0131la\u015fmamak i\u00e7in mevcut yal\u0131t\u0131ms\u0131z binalar\u0131m\u0131za \u0131s\u0131 yal\u0131t\u0131m\u0131 yapt\u0131rmak art\u0131k bir zorunluluk haline gelmi\u015ftir.<\/p>\n<p>MADDE 10 \u2013 (1) Bu Y\u00f6netmelik h\u00fck\u00fcmleri uyar\u0131nca TS 825 standard\u0131nda belirtilen hesap metoduna g\u00f6re, yetkili makina m\u00fchendisi taraf\u0131ndan haz\u0131rlanan &#8220;\u0131s\u0131 yal\u0131t\u0131m\u0131 projesi&#8221; imara ili\u015fkin mevzuat gere\u011fince yap\u0131 ruhsat\u0131 verilmesi safhas\u0131nda tesisat projesi ile birlikte ilgili idarelerce istenir.<\/p>\n<p><b>Bina Enerji Performans\u0131 (BEP) Y\u00f6netmeli\u011fi<\/b><br \/>\n<b>* Bina Enerji Performans\u0131 Y\u00f6netmeli\u011fi \u0130lkeleri<\/b><br \/>\n(1) Yeni bina tasar\u0131m\u0131nda, mevcut binalar\u0131n proje de\u011fi\u015fikli\u011fi gerektiren esasl\u0131 onar\u0131m ve tadilat projelerinde, mekanik ve elektrik tesisat de\u011fi\u015fikliklerinde binan\u0131n \u00f6zelliklerine g\u00f6re bu Y\u00f6netmelikte \u00f6ng\u00f6r\u00fclen esaslar g\u00f6z \u00f6n\u00fcne al\u0131n\u0131r.<br \/>\n(2) Binan\u0131n mimari, mekanik ve elektrik projeleri, di\u011fer yasal d\u00fczenlemeler yan\u0131nda, enerji ekonomisi bak\u0131m\u0131ndan bu Y\u00f6netmelikte \u00f6ng\u00f6r\u00fclen \u015fartlara uygun de\u011fil ise, ilgili idare taraf\u0131ndan yap\u0131 ruhsat\u0131 verilmez.<br \/>\n(3) Bu Y\u00f6netmelik esaslar\u0131na uygun projesine g\u00f6re uygulama yap\u0131lmad\u0131\u011f\u0131n\u0131n tespiti halinde, tesbit edilen eksiklikler giderilinceye kadar binaya, ilgili idare taraf\u0131ndan yap\u0131 kullan\u0131m izin belgesi verilmez.<\/p>\n<p><b>Y\u00f6netmelik G\u00f6rev, Yetki ve Sorumluluklar\u0131<\/b><br \/>\nBu Y\u00f6netmelik h\u00fck\u00fcmlerinin uygulanmas\u0131ndan;<br \/>\na) \u0130lgili idareler,<br \/>\nb) Enerji kimlik belgesi d\u00fczenlemeye yetkili kurulu\u015flar,<br \/>\nc) Yat\u0131r\u0131mc\u0131 kurulu\u015flar,<br \/>\n\u00e7) Bina sahipleri, bina y\u00f6neticileri veya enerji y\u00f6neticileri,<br \/>\nd) \u0130\u015fletmeci kurulu\u015flar,<br \/>\ne) \u0130\u015fveren veya temsilcileri,<br \/>\nf ) Tasar\u0131m ve uygulamada g\u00f6revli mimar ve m\u00fchendisler,<br \/>\ng) Uygulay\u0131c\u0131 y\u00fckleniciler ve \u00fcreticiler,<br \/>\nh) Binan\u0131n yap\u0131lmas\u0131nda, kullan\u0131m\u0131nda ve enerji kimlik belgesi d\u00fczenlenmesinde g\u00f6rev alan m\u00fc\u015favir, dan\u0131\u015fman, proje kontrol\u00fc yapan ger\u00e7ek veya t\u00fczel ki\u015filer, enerji kimlik belgesi d\u00fczenlemeye yetkili kurulu\u015flar, onaylanm\u0131\u015f denetleme kurulu\u015flar\u0131 ve i\u015fletme yetkilileri, g\u00f6revli, yetkili ve sorumludur.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kentsel D\u00f6n\u00fc\u015f\u00fcm nedir?
